WhatsApp has announced a significant legal victory against NSO Group, the Israeli developer of the Pegasus spyware, which was used to hack the smartphones of 1,400 individuals in May 2019.

Judge Phyllis Hamilton ruled that NSO Group violated U.S. cybersecurity laws and WhatsApp's terms of service. During the proceedings, the judge ordered NSO Group to hand over the source code for Pegasus. However, the company refused, suggesting instead that an Israeli citizen conduct an inspection in Israel—a proposal the court rejected. A jury trial in March 2024 will determine the damages owed.

WhatsApp stated that this decision sends a clear message that unlawful actions by surveillance companies will not go unpunished . The ruling marks a significant step in protecting user rights and civil society from digital espionage.

Further court hearings will finalize the compensation amount for the damages caused.
