Brazilian Federal judge cancels the suspension of Telegram, "considering the broad impact on the freedom of communication of thousands of people who have nothing to do with the facts under investigation."

The daily fine of R$ 1 million for not providing information about groups remains in effect.

Federal judge Flávio Lucas, from the 2nd Specialized Panel of the Federal Regional Court of the 2nd Region (TRF-2), partially suspended the injunction issued by the Federal Court of Espírito Santo that temporarily suspended the Telegram app in Brazil.

The decision was published on Saturday (29). According to the judge, the complete suspension of the app throughout the country "is not reasonable, considering the broad impact on the freedom of communication of thousands of people who have nothing to do with the facts under investigation."

However, the judge maintained the daily fine of R$ 1 million imposed by the lower court for non-compliance with the order to provide data "from all users" of channels with neo-Nazi content, mainly their administrators. The merits of the writ of mandamus still need to be judged by the TRF-2.
