Brazil's Federal Prosecutor's Office sent a request to Telegram over a mass mailing to Brazilian users criticizing the Censorship Bill.

In its request, the agency states that Telegram must provide the following data within 10 days:

  1. Explain why the platform has sent an article showing the dangers of a project that could help censorship;
  2. Send personal data of employees (full name and email) who drafted the text, as well as an excerpt from Telegram's terms of use permitting mass mailings of messages other than technical updates;
  3. Explain why the message was sent to all users, not just subscribers to the Telegram Brasil channel, even if it is an issue that directly interferes with the use of the platform.

In addition, the agency asks whether Telegram has a feedback mechanism that allows it to challenge content published on behalf of the platform, and whether the messenger provides opportunities for publishing materials with a position that differs from the messenger's position.

At the same time, the Federal Prosecutor's Office recognizes that platforms have the right to defend their positions in the public sphere, but such protection must respect the fundamental rights of their users.
