OpenAI has filed a countersuit against Elon Musk, asking the court to block his ongoing attacks and what it calls a “fake takeover bid,” according to The Verge.

In the complaint, OpenAI’s lawyers claim Musk’s actions are intended to undermine the future of the company and must be stopped. They are seeking to prohibit what they describe as illegal and unfair conduct, and to hold Musk accountable for the harm caused.

“Elon’s nonstop actions against us are just bad-faith tactics to slow down OpenAI and seize control of the leading AI innovations for his personal benefit,” the company posted on X.

Musk, one of OpenAI’s original co-founders, initially sued the company in early 2024, claiming it had strayed from its mission to develop AGI for the benefit of humanity. He withdrew the suit in June 2024 and refiled it in August. The case is set for trial in spring 2026.

In February 2025, Musk made a $97.4 billion offer to acquire OpenAI, arguing it was time for the company to return to its open-source roots. OpenAI declined the offer.
